What is a retainer?
A retainer is a contract between yourself and your lawyer that stipulates what services will be provided, and what fees will be paid for these services. The retainer fees are paid in advance of the commencement of work, and are held in trust by the lawyer on your behalf. Work that is performed on your file is paid our of the retainer fee, and you will receive an invoice when the work has been completed and the retainer has been billed out to cover the cost of the legal services performed. A typical initial retainer for criminal services will pay for making preliminary court appearances on your behalf, ordering and reviewing disclosure, negotiating with the Crown Prosecutor, and providing advice as to the relative merits of your case.
